Abstract This paper examines the ethical issues raised, in the framework of the concept of human milk donation. Initially, the concept of donation and its various types, such as formal donation via public human milk banks, informal "donation" via internet, purchase as alleged donation through private banks and via internet, are analyzed. Based on the principles of maximization of possible benefit and minimization of possible harm, the best practice, proposed by scientists and from an ethical point of view, is to receive breast milk via public breast milk banks. In continuation, donation is referred as a moral act and is promoted through the moral duty of solidarity. Are there any preconditions in order to assess donation as a moral act? Is the purchase of a human tissue such as human milk through an alleged donation ethically acceptable? The focal points of this paper are the following: is the choice of parents not to use the "best practice" for their neonates, due to religious or personal reasons morally fair? Are there specific requirements for the access of neonates to such appropriate treatment? Is the use of an unsafe "good" morally acceptable? What are the requirements, according to which a mother can donate milk? By reviewing the current literature is evident that there exists an obligation of the State, to establish and operate public human milk banks, in order to promote and ensure the optimal health of the population of the newborns. Through a network of public banks, the "injustice" that infants undergo, due to lack of access to breast milk, is reduced. However, it must be ensured that, both the donation and use of breast milk will be implemented with respect to the autonomy of the individual and with the informed consent of the newborn's family. Access should be provided in terms of fairness and taking into account that newborns in Neonatal Intensive Care Units have the greatest need.
