Abstract The paper is interested in the institutional constitution, at the top level, of the “Greek State”, in relation to the authoritarian know-how of the interwar state institutions in Greece. Its core and starting point is the genealogy of its legislative process during the years of the Metaxas dictatorship and even further back, during the Second Hellenic Republic. Its aim is to grasp the basic, quasi 'constitutional' legal structure with which the State tried to bridge it's inherent contradiction. The need, on the one hand, to be a functional component of an unconstrained and beyond any control occupation mechanism, and on the other hand, to present itself as the projection and continuation, in the present and in the future, of a self-existent and autonomous legal order. A contradiction which, the more it emerges, the more it underlines the role of the inter-war know-how of authoritarian governance in the scope of the constitution and operation of the Greek Collaboration Governments.
