Abstract The present thesis deals with the matter of donation of human gametes and specifically with the donation of sperm as a method of medically assisted reproduction technology (ART). Heterologous conception is one of the most widespread methods of ART and includes practices such as egg donation and surrogacy. The involvement of a third person in the process of procreation brings to light a series of ethical concerns and solutions that define the formation of a regulatory basis, a system of principles for ethical decision making. A basic field of controversial reason is the question of whether or not the donor should remain anonymous. This dilemma emerges from the conflict that appears to arise between the fundamental right to the private life of the donor and the parents (privacy) and the controversial right to the knowledge of the biological origin of the child (the right to know). The right to know the origin is subject to an additional right, that of knowing the way in which the embryo is conceived (the right to be told) and the parents' option to disclose this information to the child. Although anonymity has been the norm for many years, based on the fundamental right to privacy, in recent years views that prioritize the knowledge of particular genetic and biological information seem to gain ground. The tensions created between individualistic assumptions of autonomy lead to multi-level conflicts of rights, which give rise to a descriptive indication of the matter and do not lead to the solution of practical problems. The purpose of this thesis was neither to prove the prevalence of one right over the other, nor to prove the validity of the existence of a right to the knowledge of biological origin. The aim of the present thesis was to highlight a way of ethical decision-making on issues related to the heterologous fertilization. To be more specific, it seems that if we wanted to propose solutions, we would have to go beyond individual autonomy. A different way of approaching the present issue and at the same time a strong basis for its consideration was the Kantian theory of autonomy. As highlighted, the preservation of anonymity is the only way that may have a universal principle, as the failure constitutes a violation of the autonomy of the donor and the parents. Both parents and the child of heterologous fertilization are required to respect the donor's choice of anonymity and to act by protecting the autonomy of others. However, it is clear that this is not the case for health reasons.
