Abstract

The current thesis deals with the institution of involuntary psychiatric hold of mentally ill persons and the corresponding issues, both legal and bioethical. It begins presenting the historic evolution of it (Part 1), continues with the bioethical concerns raised from the practice of compulsory hospitalization (Part 2), and ends with the modern legal remedy (Part 3). In particular, Part I attempt to present a definition of mental health and illness (I), its phenomenology (III), as well as the role of psychiatric reform (IV, V, VI) in the social reintegration of the mentally ill persons. Part II analyzes the various bioethical concerns raised by the institution of involuntary psychiatric hold, both as an institution restricting freedom (I) and as an institution limiting the autonomy and dignity of the individual (II), according to the philosophical theory of J.S. Mill (A), as well as the theory of Imm. Kant (B). Moreover, both the moral and legal treatment of the mentally ill persons is being presented in details (III) and the current part closes by analyzing the two dimensions of the institution of involuntary psychiatric hold (IV). Part III of this thesis defines the legal framework for activating the measure of involuntary psychiatric hold, both before (I) and under (II) the currently enacted Law 2071/1992. Also, this Part presents specific legislative initiatives taken after the enactment of the above law towards the promotion of mental health (III) and the current part closes with the problems and inconsistencies in the practical application of this law (IV). Finally, Part IV makes suggestions and conclusions, which were extracted from the above interdisciplinary presentation of the treatment of mental health over time.
