Abstract The aim of this thesis is to examine the bioethical concerns, regarding the pressure exerted on the human and constitutional rights and specifically on the rights of privacy, protection of personal data, while efforts of constraining the pandemic of Covid-19 are still in progress. The main inquiry lies on the following questions. Are the interferences on personal autonomy and the right to privacy through coercing measures, which constrain human freedom -such as quarantine, lockdowns, shutting down the frontiers- morally and legally justified? This paper also focuses on the tools recommended by the World Health Organization (‘W.H.O’) aiming at the protection of public health, such as contact tracing in order to break the transmission chains of the disease; in particular, questionable contact tracing methods, such as digital proximity tracking applications etc, are being analyzed herein. Following thorough examination of the above-mentioned issues, it is concluded that these methods shall respect the individual’s right to personal data protection, in harmony with the principles of data minimization, limitation storage principle etc. Furthermore, it is hereby concluded that public health protection shall not deprive one’s life of its full meaning (the conceptual meaning of the terms “life” and “bios” is being explicitly defined). From a bioethical aspect, it is not justified to sacrifice rights in order to preserve life by any cost, or to protect public ends in general. Nevertheless, through the analysis of legal theories and terms, such as the public interest and proportionality principle, it is hereby assessed that human rights and especially the right to privacy should adjust to extreme social circumstances, such as public health crises. Conclusively, the fundamental human rights such as the right to privacy could be adjusted in troubling eras in order to preserve human dignity. Human dignity has absolute and non- negotiable value and, thus, it must not be restricted or modified, in any social necessity that arises.
